1. Overview

SmartUtilityTool respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the SmartUtilityTool website when those claims are submitted in compliance with this policy.

If you are a copyright owner, or authorised to act on behalf of one, and you believe that copyrighted work has been copied in a way that constitutes copyright infringement on or through our Site, please submit a written DMCA notice to our designated copyright agent as described below.

2. Requirements for a Valid DMCA Notice

To be valid under the DMCA, your written notice of alleged copyright infringement must include all of the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and that you want removed, with enough detail for us to locate it on our Site (e.g., the specific URL).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or applicable law.
  5. Accuracy statement: A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf.
  6. Physical or electronic signature: Your physical or electronic signature (typing your full name will suffice as an electronic signature).

Notices that do not comply with all DMCA requirements may not receive a response. Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing may be subject to liability.

3. Submit a DMCA Takedown Notice

We strongly recommend submitting your notice by email as it allows for the fastest response. Please use the subject line: "DMCA Takedown Notice".

Upon receipt of a valid DMCA notice, we will:

  • Acknowledge receipt of your notice within 3 business days
  • Remove or disable access to the allegedly infringing material promptly
  • Notify the person responsible for the allegedly infringing material
  • Take other actions as required by law

4. Counter-Notice Procedure

If you believe that material you posted on the Site was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notice to our Copyright Agent. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you are outside the United States, for any judicial district in which we may be found

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, SmartUtilityTool has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. SmartUtilityTool may also at its sole discretion limit access to the Site for users who infringe intellectual property rights of others.
