2. Requirements for a Valid DMCA Notice

- Accuracy statement: A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf.
- Physical or electronic signature: Your physical or electronic signature (typing your full name will suffice as an electronic signature).
Notices that do not comply with all DMCA requirements may not receive a response. Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing may be subject to liability.
3. Submit a DMCA Takedown Notice

Upon receipt of a valid DMCA notice, we will:
- Acknowledge receipt of your notice within 3 business days

- Notify the person responsible for the allegedly infringing material
- Take other actions as required by law
4. Counter-Notice Procedure
If you believe that material you posted on the Site was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notice to our Copyright Agent. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you are outside the United States, for any judicial district in which we may be found
Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed material.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, SmartUtilityTool has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. SmartUtilityTool may also at its sole discretion limit access to the Site for users who infringe intellectual property rights of others.
